‘Privileges not given to Eknath Shinde’, says Nagpur bench

Nagpur: Chief Minister Eknath Shinde has found it costly to challenge a decision of State Cooperative Minister Atul Save. The Nagpur bench of the High Court has directed that the Chief Minister has no privilege to interfere in the affairs of the minister of the concerned department.

Cooperative Minister Atul Save had given orders for recruitment in Chandrapur District Central Co-operative Bank. Last year, on November 29, 2022, the Ministry of Cooperation of Atul Save had issued an order in this regard. But, Chief Minister Eknath Shinde stayed this order. Later Chandrapur District Central Cooperative Bank approached the court against this decision.

The court has clamped down on the affairs of the Chief Minister. The court said that Chief Minister Eknath Shinde has no right to overturn or reconsider the minister’s decision. The order given by Cooperative Minister Atul Save regarding recruitment in Chandrapur District Central Cooperative Bank was of administrative nature. The court made it clear that only the minister of the concerned department can reconsider or amend this decision.

The Chief Minister has no right to interfere in the jurisdiction of the co-tax department. It was argued on behalf of the bank that this is a violation of the principle of natural justice. After that, the court has also ordered to uphold the decision of Atul Save.

A bench of Justice Vinay Joshi and Justice Menzhes said that no privilege is given to the chief minister under the industrial policy of the state of Maharashtra. Therefore, the Chief Minister has no right to review or change the decision taken by any minister with respect to his portfolio. He said that the ban on the decision of the Ministry of Cooperation by the Chief Minister is completely unnecessary and without legal authority.
