Central govt opposes same-sex marriage in SC! Said – Can’t impose thinking of urban elite on whole society

New Delhi: Same-Sex Marriage: The central government has filed a new application in the Supreme Court against same-sex marriage. The central government has questioned the Supreme Court’s view on the petitions legalizing same-sex marriage.

Central government said that marriage is a social institution and the power to create any new rights or recognize relationships rests only with the legislature and does not come under the ambit of the judiciary. In the application, the government said that the ‘Supreme Court should consider the maintainability of the petitions whether they can be heard or not. Laws can be made only by the legislature, not by the judiciary. The petitioners have sought to create a new institution of marriage, which is different from the concept of existing laws. The institution of marriage can only be recognized by a competent legislature.’

15 petitions were filed in the Supreme Court to legalize same-sex marriage in the Supreme Court. While hearing these petitions, a three-judge bench of the Supreme Court had directed to refer these petitions to a five-judge constitution bench. The Supreme Court may hear them on April 18.
