How Alimony is Decided?
There’s no exact formula in Indian law to decide the amount of alimony. Courts decide the amount depending on the type of case. Supreme court had declared last year that alimony is not only to punish one partner but it is paid to secure financial stability of dependent partner. The Supreme Court had decided mainly eight factors in same directive. Those are :
1. Financial condition of both parties
2. Their earning capacity
3. Contributions made during the marriage
4. Needs of the wife and children
5. Husband’s financial position and liabilities
6. Wife’s lifestyle during the marriage
7. Did either party compromise on his/her career?
8. Does the wife have her own sources of income?
Can Male Partner Demand for Alimony?
Usually, it is believed that only wife is eligible for alimony. However, according to Indian Law, even husbands can also demand alimony. Under Sections 24 and 25 of the Hindu Marriage Act, 1955, if a husband proves that he was financially depended on wife, he can demand alimony. However, court conducts strict investigation and husband also needs to prove that he was unable to work due to genuine reasons.
