Burger King Pune: The Burger King trademark dispute has taken a new turn as the Supreme Court of India paused an earlier order by the Bombay High Court. This decision gives temporary relief to the famous Pune-based eatery using the name “Burger King.” A local restaurant in Pune has been using the name “Burger King” for its food business. However, Burger King Company LLC, the famous global fast-food brand, filed a case. They claimed the Pune restaurant was using their registered trademark without permission.

Earlier, the Bombay High Court had stopped the Pune eatery from using the name. The court said it violated trademark rights and could harm the global brand. On March 11, 2025, the Supreme Court stayed (paused) that order. This means the Pune-based restaurant can continue running its business under the same name for now.
The bench, led by Justice Sanjiv Khanna and Justice Dipankar Datta, gave this order. They passed the stay after hearing a Special Leave Petition from the Pune restaurant. The Burger King trademark dispute is not over. The Supreme Court has only granted temporary relief. It has not yet decided if using the name “Burger King” is legal for the Pune restaurant. Both sides will present more evidence in the coming hearings.
This case highlights major issues in trademark law. It raises questions like: Can a small business use a name already famous worldwide? How should courts balance big brands’ rights and local business survival?
For now, the Pune restaurant can continue using “Burger King.” But the final answer lies in the court’s upcoming decision.
