Pune: Prominent real estate developer Rohit Gera has found himself embroiled in a data theft controversy. The Samarth police have issued a notice under Section 35(3) of the Indian Penal Code to Gera, who is one of the accused in the case. The police have also recorded his statement.
Meanwhile, Gopal Agarwal, the complainant in the case, has approached the state home ministry seeking police protection, citing threats to his life and family. Agarwal, a Pune-based businessman, alleges that his former business partner Sudarshan Mitra and Gera, the managing director of Gera Developments Pvt. Ltd., stole proprietary source code and sensitive data from his company, RollingDice Technologies Pvt. Ltd.

The stolen data was allegedly used to launch a rival company, HomeOne Technologies LLP. Agarwal claims that the police initially tried to protect the accused but a court order mandated a reinvestigation, prompting the police to involve a cyber expert.
In response to Agarwal’s allegations, Gera and Mitra have not yet publicly commented. However, a senior police officer confirmed that Gera’s statement has been recorded and the investigation is ongoing.
Agarwal remains concerned about his safety and has expressed disappointment with the police’s handling of the case. He has accused Senior Police Inspector Umesh Gitte of delaying the investigation and failing to take adequate action.

Agarwal’s legal representative, Rajas Pingle, has highlighted the potential liability of HomeOne Technologies’ partners under Section 85 of the Information Technology Act. This provision could implicate individuals who directly or indirectly benefited from the data theft.
As the investigation progresses, it remains to be seen whether the authorities will be able to unravel the complex web of allegations and bring justice to the aggrieved party.
